Terms of use
Last updated 2026-10-19
These terms cover this website and what it offers for free: the Yuyari Standard, the self-assessment, and
the request form. They are an agreement between you and Michael Mckenna, an individual doing business as Yuyari
in New York (“Yuyari”, “we”). By using the site you accept them. If you use it for an organization, you
accept them for that organization and confirm you may. You must be 18 or older.
In short. The Standard is free to use under
CC BY 4.0. The self-assessment grades numbers you enter, in your browser, and nobody checks them. Its
result is your own self-assessment: it is not a Yuyari assessment, a certification, or legal advice. Paid
work happens only under a separate signed agreement.
1. The Yuyari Standard
The text of the Standard is licensed under
Creative Commons Attribution 4.0. You may
copy, adapt and share it, including commercially, if you credit it. The license covers the text only.
The name Yuyari, the tier names and the conformance marks are not licensed, and the Standard says when
they may be used (§8.4). The Standard is a public draft and will change. A result is bound to the version
it was obtained under.
2. The self-assessment
- It runs on your device. The grade is computed in your browser from what you enter.
Only what the privacy notice lists reaches us, and only if you ask for the gap
report.
- It checks arithmetic and structure, not truth. It does not see your model, your data
or your process, and cannot tell whether the numbers you enter are accurate or were obtained as you
describe. You are responsible for what you enter.
- Its result is self-reported. Any tier or verdict it shows is marked self-reported
(for example
W2-self), cannot exceed Tier 3, and is valid for 90 days for the model version
you entered, because nothing in it was independently reproduced.
- How you may describe it. You may say that your organization self-assessed against
the Yuyari Standard and quote the designation with its
-self marking. You may not present it,
or anything derived from it, as an assessment, opinion, certification or endorsement by Yuyari or any
assessor.
3. Not advice, no relationship
The site, the Standard and the self-assessment give general information and software. They are not
legal, regulatory, compliance or other professional advice. Using them, or sending us a request, does not
create a client, advisory or assessor relationship. Whether a regulator, auditor, insurer or court accepts
any evidence is for them to decide.
4. Requests and paid work
Sending the request form starts a conversation and commits neither of us to anything. A Deletion
Assurance Review, a Rehearsal Engagement or any other paid work is governed only by a separate written
agreement signed by both parties, which these terms do not modify.
5. Acceptable use
Do not use the site to break the law or infringe anyone's rights. Do not interfere with it, probe it for
vulnerabilities without our permission, submit automated or bulk requests, or submit other people's
personal data. Do not use the Standard or anything on this site to install, elicit or distribute
capabilities that could cause serious harm.
6. Our content
Apart from the Standard's text (§1), the site's content, design and code belong to us or our licensors,
and these terms grant you no rights in our name or marks.
7. Disclaimers
THE SITE, THE STANDARD AND THE SELF-ASSESSMENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”,
WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY OF THEM WILL DETERMINE WHETHER A MODEL
HAS FORGOTTEN ANY DATA OR CAPABILITY, OR THAT ANY RESULT WILL SATISFY ANY LAW, REGULATOR, AUDITOR OR
INSURER.
8. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE
OF THE SITE, THE STANDARD OR THE SELF-ASSESSMENT. OUR TOTAL LIABILITY FOR THEM IS LIMITED TO ONE HUNDRED
U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, AND THEN THEY APPLY ONLY AS FAR AS
ALLOWED.
9. Indemnity
You will compensate us for third-party claims arising from your breach of these terms, including
presenting a self-assessment as a Yuyari assessment or certification.
10. Changes, suspension, transfer
We may change the site or these terms. If a change matters, the date above changes and the new terms
apply from then. We may suspend access for a breach. We may transfer these terms, and the business, to a
company we form to carry it on; your rights under them stay the same. Sections 3 and 6–11 survive.
11. Law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws
rules. The state and federal courts located in New York have exclusive jurisdiction over disputes about
them, and both of us consent to that. If any part is unenforceable, the rest stands. These terms and the
privacy notice are the whole agreement about the free site.
